In the Jurist.org blog, Dr. Sujitha Subramanian, Lecturer in law, discusses the Indian Supreme Court’s ruling that upheld the constitutional validity of the legislation that criminalises anyone voluntarily having carnal intercourse against the order or nature. Sujitha argues that by not engaging with the issue in any substantive manner, and merely pointing to the legislature to protect the “so-called” rights of LGBT community which is only a “minuscule fraction” of the population - the Supreme Court has not only revealed its pre-colonial mind-set but also departed from its activist disposition.
